EFFECTIVE DATE: Shipment Date
- Akon LLC warrants its Indoor Curtains to be free from defects in materials and workmanship to the following extent: In the event defects in workmanship or materials are reported to AKON LLC within 5 years of date of order, the Company will repair or replace if not repairable, at its option, such defects or products to eliminate the defect.
- Akon LLC warrants its Outdoor Curtains to be free from defects in materials and workmanship to the following extent: In the event defects in workmanship or materials are reported to AKON LLC within one year of date of order, the Company will repair or replace if not repairable, at its option, such defects or products to eliminate the defect. This does not include damage resulting from environmental conditions that include, but are not limited to wind, rain, temperatures and UV light.
- Akon LLC warrants its Curtain Tracks to be free from defects in materials and workmanship for the lifetime of ownership of the purchasing party. The Company will repair or replace if not repairable, at its option, such defects or products to eliminate the defect.
Warranty Terms
- In no event will the cost of this obligation exceed the net selling price of the item as covered by your invoice.
- This warranty applies only under conditions of normal use and does not apply to defects which result from negligence, misuse, unapproved modification, or accidents.
- THERE ARE NO OTHER WARRANTIES, EXCEPT AS EXPRESSLY SET FORTH ABOVE, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTS ABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. The Company’s liability with respect to its installation shall not exceed that expressly set forth above, irrespective of the theory upon which any claim might be based, including breach of contract, warranty, negligence or strict liability in tort, and under no circumstance shall the company be liable for incidental or consequential damages as a result of missing items, damaged items, or wrong items.
- The company’s responsibility and obligation under this agreement is limited to the exchange of any defective part which may be returned and which proves defective. This warranty does not include the loss of business, cost of labor, damages or other miscellaneous expenses incurred.
- The company will not be responsible for any damages incurred by the customer due to improper use of the product, lack of delivery of the product, or a product that is not to specification.
Terms and Conditions For Missing or Wrong Content
- If your order does not included quoted content, or you suspect missing content, AKON must be immediately notified immediately before installation.
- Do not install your order as it will need to be returned for repair or to remedy what is missing.
- Under no circumstances will AKON be liable for expenses related to missing content or content that was not quoted.
- In no event will the cost of this obligation exceed the net selling price of the item as covered by your invoice.
- In no event will any costs be deducted from an AKON invoice by means of the customer using non AKON personal to perform fixes, repairs, or installations of content that was not included, missing, or defective without the express written consent of an AKON representative.
Outside of The Continental United States
- Akon will not ship any replacement parts outside of the continental United States.
- This includes any replacement parts that are required for any reason, even if the product was defective or wrong.
- These parts will be made available for pickup or they can ship to the customer's designated export point.
Timelines For Notifications
Stock product is eligible for a refund if returned within 30 calendar days of your purchase and undamaged and restock fees may apply. Customer pays return freight and restocking fee. Custom products are non-refundable unless manufacturer defect. We must be made aware of manufacturing defect within 60 calendar days. For orders over $10k, we must be made aware of manufacturing defect or shortages within 90 calendar days. If notified after, this product will not be eligible for refund, repair or exchange. Customer will be refunded to the original payment method used during the purchase if undamaged. For credit card payments it may take 5 to 10 business days for a refund to show up on your credit card statement.
